Terms and Conditions for Services and Digital Access

These terms govern live classes, the Mindful Face Space subscription, access to digital materials, and payments made through shamrei.space and related channels.

Edition and application of these terms

  • Edition date: June 3, 2026.

These Terms and Conditions for Services and Digital Access, referred to below as these terms, apply to the offers of Yuliya Shamrei published on shamrei.space, related checkout pages, and other participation channels whenever it is stated before payment that these terms apply to the offer.

1. Provider

All prices are stated in euros. Information on whether VAT is included or not is shown in line with the applicable tax status of the provider on the relevant offer page or in the payment documents.

2. Scope of application

  • Offer 1: group Awareness Through Movement classes.
  • Offer 2: the Mindful Face Space subscription.
  • Offer 3: the digital product Somatic Bedtime Stories.
  • Offer 4: other offers whenever the application of these terms is expressly stated before payment.

The specific description of the offer, its price, scope, schedule, duration, term, or access conditions is communicated to the participant before payment on the relevant offer page or in an individual message from the provider.

If special conditions for a specific offer differ from these terms, those special conditions apply to the relevant part if they were communicated to the participant before payment.

3. Participant and consumer

  • Participant: a natural person who orders and pays for the provider's offer or receives access to it.
  • Consumer: a participant who purchases the offer mainly for personal purposes unrelated to their business or professional activity.

4. Formation of the contract

  • Basis of conclusion: the contract between the provider and the participant is concluded after payment for the selected offer or after the subscription with automatic recurring payment has been completed and the order has been confirmed.
  • Before payment 1: the participant is provided with the description and price of the offer.
  • Before payment 2: the participant is informed about the participation period or the conditions of digital access.
  • Before payment 3: the participant is informed about the subscription terms and automatic recurring charges, if applicable.
  • Before payment 4: the participant is informed about cancellation rules, missed sessions, and the availability of recordings, if applicable.
  • Before payment 5: the participant is provided with these terms and information about the consumer's right to withdraw from a distance contract, if that right applies.

By making a payment or taking out a subscription, the participant confirms acceptance of the offer conditions and these terms.

Confirmation of the purchase, participation conditions, subscription, and applicable consents may be sent to the participant by email provided during checkout or through the payment platform used.

5. Payment and participant data

Payment is made using the method available on the relevant offer page or otherwise agreed separately with the provider.

The participant must provide accurate contact and payment details and is personally responsible for maintaining access to the stated email address, Telegram account, and any other services needed to receive the paid offer.

The provider is not responsible if access or a notice cannot be sent because the participant provided incorrect data, lost access to their account, or blocked the receipt of messages.

Bank fees, payment system fees, and currency conversion costs, if they arise on the participant's side, are borne by the participant.

6. Nature of the services and no guarantee of results

The provider's services and materials are intended for self-directed exploration of movement, attention, sensations, gentle face and body practices, rest, and the development of a regular personal practice.

The services and materials do not constitute medical diagnosis, treatment, physiotherapy, psychotherapy, cosmetic or medical procedures, rehabilitation programs, or a substitute for consultation with a physician or another qualified specialist.

The provider does not guarantee any specific physical, aesthetic, emotional, therapeutic, cosmetic, or other result. Results depend on the participant's individual characteristics, health condition, regularity and manner of practice, and other circumstances outside the provider's control.

7. Safe participation

The participant independently assesses their condition and their ability to take part in classes or use the materials on their own.

If the participant has injuries, acute pain, dizziness, recent surgery, pregnancy, chronic illness, or any other condition that may be relevant to the practices, the participant is advised to consult an appropriate medical professional before taking part.

The participant agrees to practice only within a personally comfortable range, not to perform movements through pain or abrupt force, and to stop the practice if pain, significant discomfort, dizziness, or a deterioration in wellbeing occurs.

Nothing in these terms limits the provider's liability in cases where such liability cannot be excluded or limited under applicable law.

8. Format of group classes

The participant purchases a package for participation in live online Awareness Through Movement classes held according to the provider's schedule.

Group classes are a live participation service. Payment for the package does not mean the purchase of video recordings, an online course, or perpetual access to materials.

9. Package price and validity period

  • Package price: 8 group classes for 155 euros.
  • Validity period: 10 calendar weeks from the date of the first class used or booked by the participant within the relevant package.

After the package validity period ends, unused classes expire and are not transferred or financially reimbursed, except where the class was cancelled by the provider or where mandatory law expressly provides otherwise.

10. Schedule and missed classes

The current class schedule is communicated to the participant before payment or published in the communication channel used.

If the participant informs the provider that they cannot attend more than 24 hours before the start of the class, the class is not deducted from the package and may be used within the package validity period.

If the participant gives notice less than 24 hours before the start of the class, notifies the provider on the day of the class, or does not attend without prior notice, the class is considered used and is deducted from the package because the place and opportunity to participate were reserved for the participant.

11. Recordings of missed group classes

If a class is deducted from the package because of late notice or the participant's absence, the provider sends the participant a recording of that class if a recording was created and if providing it is technically possible.

The recording is provided as an additional opportunity for independent practice and does not change the status of the class as used.

Providing a recording, including through Telegram, does not mean the recording is transferred into the participant's ownership, does not grant perpetual access, does not create a right to require the provider to keep the recording in the previous channel, and does not grant a right to pass the material to third parties.

12. Individual session instead of three deducted missed classes

If, within one active package, 3 missed group classes have been deducted, the participant may replace those 3 deducted classes once with 1 individual online session at no additional charge.

To use this right, the participant must contact the provider before the relevant package expires or no later than 30 calendar days after the third missed class was deducted, whichever occurs later.

The date of the individual session is agreed based on the provider's available schedule. The individual session must take place within 60 calendar days after the request is agreed unless the parties agree otherwise in writing.

After the individual session has taken place, the corresponding 3 group classes are finally treated as used and cannot be restored, replaced again, or compensated.

13. Cancellation by the provider or technical failure

If a class is cancelled by the provider or cannot take place because of a technical failure on the side of Zoom or another platform used by the provider that the participant could not prevent, the class is not deducted from the package unless an equivalent replacement is provided.

The provider may offer a rescheduled class, an extension of the package period, or another equivalent format. If an equivalent replacement is not possible, the value of the unprovided part of the service is refunded in the cases required by applicable law.

14. Format of Mindful Face Space

Mindful Face Space is an online practice space that includes live classes, access to a library of recordings, materials for independent practice, a participant chat, and other elements stated in the offer description before the subscription is taken out.

The library may include class recordings previously created within the Laboratory as well as new materials added during the operation of the Space.

The participant purchases the right to participate in the Space and temporary access to its materials for the period of an active paid subscription. The participant does not purchase the library or any individual recordings as property or for perpetual use.

15. Subscription price and automatic renewal

  • Subscription price: 59 euros per month.
  • Automatic renewal: the subscription is set up with automatic monthly recurring payment and remains active until it is cancelled by the participant or terminated by the provider.
  • Confirmation 1: payment is charged automatically for each new monthly billing period.
  • Confirmation 2: access to the Space is provided only for the duration of the paid subscription.
  • Confirmation 3: to stop future charges, the subscription must be cancelled before the date of the next payment.

The provider sends the participant a reminder about the upcoming recurring charge and the option to cancel the subscription before the start of the period during which the participant can prevent the next payment, if such notice is required by applicable law or provided by the payment system used.

16. Cancellation of the subscription by the participant

The participant may cancel the subscription at any time before the date of the next automatic charge through the available interface of the payment platform or by sending a request to the provider using the email address above.

After cancellation, no new payments are charged. Access to the Space remains available until the end of the already paid monthly period and ends after that period expires.

Early termination of access at the participant's initiative during an already paid period does not entitle the participant to a refund of the proportional part of the payment, except where such a refund is mandatory under applicable law.

17. Library access and missed live classes

Access to the library of recordings, materials, and the chat remains available only during an active paid subscription.

After the paid period ends or the subscription is cancelled, access to the library, recordings, materials, and chat ends.

The library may be expanded, updated, reorganized, and moved to another technical platform. Such changes do not mean that the participant acquires a right to preserve a specific composition of the library forever.

If the participant does not attend a live class during a paid subscription period, this does not create a right to recalculation or refund because the subscription grants access to the entire Space during the paid period, including available recordings and materials.

18. Change of the price or composition of the Space

The provider may change the subscription price for future billing periods, as well as the schedule, class composition, library structure, and platform used.

The participant is informed about a change of price or another material change of participation conditions at least 30 calendar days before the first automatic charge under the new conditions.

If the participant does not agree with the changes, the participant may cancel the subscription before the relevant charge.

19. Termination of the Space or the subscription by the provider

The provider may end the participant's subscription at the end of the current paid period by notifying the participant before the next charge.

The provider may discontinue the operation of the Space and, where possible, will notify participants at least 30 calendar days in advance.

If access is terminated on the provider's initiative before the end of an already paid period and the reason is not related to the participant's breach, the provider offers an equivalent replacement or refunds the value of the unused part of the paid period in line with applicable law.

20. Subject matter and price of Somatic Bedtime Stories

  • Product price: 12 euros.
  • Access format: the product is provided through Telegram in the form of access to the relevant digital materials or to a closed space with materials, unless something else is expressly stated before payment.

Somatic Bedtime Stories is a recorded digital product for independent personal practice.

21. Access period

After payment and subject to the requirements of applicable law, the participant receives personal access to the Somatic Bedtime Stories materials without a pre-set end date.

Access remains available for as long as the provider continues the relevant activity, supports the product, and technically provides access to it through Telegram, the shamrei.space website, or another replacement platform.

Such access is not a promise of lifetime storage of the materials, perpetual existence of the Telegram channel, website, or any other platform, or permanent continuation of the provider's activity.

The provider may move the materials from Telegram to the website or another platform, change the technical access method, or replace the service used provided access to the product is preserved within the provider's existing obligations.

If the provider stops supporting the product and access to it, the participant will be informed where possible at least 30 calendar days in advance.

22. Technical conditions for access to Somatic Bedtime Stories

The participant independently ensures that they have a Telegram account, a device, and an internet connection necessary to access the product.

If the participant loses access to their Telegram account or deletes the chat or channel through which the materials were provided, the provider is not obliged to restore access by a method different from the current product delivery method, except where mandatory law provides otherwise.

If Telegram becomes unavailable or stops providing the required functionality for reasons outside the provider's control, the provider may provide the participant with access to the product through the shamrei.space website or another reasonably chosen platform.

23. Personal use and intellectual property

  • Restriction 1: sharing access with third parties without the provider's prior written consent is prohibited.
  • Restriction 2: publishing, selling, copying, or distributing the materials is prohibited.
  • Restriction 3: placing the materials in group chats, cloud storage, or social networks is prohibited.
  • Restriction 4: using the materials for the participant's own classes, consultations, courses, or derivative products is prohibited.

All class recordings, audio, video, text materials, programs, class structure, images, and other materials of the provider are protected by applicable intellectual property law.

Payment for a service, subscription, or digital product grants the participant a limited right of personal non-commercial use of the materials in accordance with the conditions of the chosen offer.

In the event of a material breach of this section, the provider may limit or terminate the participant's access to the extent permitted by applicable law and may also demand that the breach stop and that resulting damage be compensated.

24. Technical availability of platforms

The provider takes reasonable measures to provide the paid access and to hold the classes.

Temporary failures of the website, Telegram, Zoom, the payment system, or another third-party platform do not constitute a breach of contract if the provider restores access or provides a reasonable replacement within an acceptable time.

If paid access or a class cannot be provided for a substantial period and no equivalent replacement is available, the participant retains the rights to remedy, replacement, extension of access, or reimbursement of the value of the unprovided part in line with applicable law.

25. Chats and communication space

If an offer includes a chat or a closed community, the participant must communicate respectfully and must not post insults, threats, unsolicited advertising, materials infringing third-party rights, or personal data of other participants without their consent.

The participant may not publish or pass to third parties any recordings, screenshots, or content from the closed space without the consent of the provider and, where applicable, of other participants.

In the event of a material or repeated breach of the rules, the provider may delete the relevant messages, limit participation in the chat, or terminate the participant's access to the communication space to the extent permitted by applicable law.

26. Consumer right of withdrawal

If the participant is a consumer and enters into the contract at a distance, the participant may withdraw from the contract within 14 calendar days without giving reasons unless applicable law provides for an exception to or early loss of that right.

For service contracts and digital access, the withdrawal period begins on the date the contract is concluded.

The participant may use the sample notice in Appendix 1, but this is not mandatory.

27. Start of services before the withdrawal period ends

If the participant wishes to begin attending live classes or using the subscription space before the 14-day withdrawal period ends, the provider may start providing the service after receiving a separate request from the participant to begin performance before that period ends.

If the participant lawfully withdraws from the contract after the service has started, the participant must pay the proportional value of the part of the service already provided up to the moment of withdrawal if applicable law permits this and the participant was properly informed in advance.

28. Digital access and digital materials

If access to digital materials is provided before the 14-day withdrawal period ends, whether the right of withdrawal remains or ends is determined by the nature of the digital supply and by mandatory law.

Where the loss of the right of withdrawal requires the participant's separate explicit consent to the immediate provision of digital content or access, together with confirmation that the participant understands the consequences of that early start, access is provided only after the necessary confirmations have been received.

The provider sends the participant a confirmation of the distance contract concluded and of the applicable consents on a durable medium, for example by email.

29. Refund after a lawful withdrawal

If the contract is lawfully withdrawn from, the provider refunds payments within the time limits and to the extent required by applicable law.

If the service started at the participant's separate request before the withdrawal period expired, the amount refunded may be reduced by the proportional value of the part of the service already provided, if this is permitted by applicable law.

After withdrawing from the contract, the participant must stop using the digital access provided and may not transfer the materials to third parties.

30. Liability

The provider is responsible for providing the paid service or digital access in accordance with the offer description and these terms.

The provider is not responsible for inability to participate or use the materials arising from reasons on the participant's side or from circumstances outside the provider's reasonable control, provided the provider has taken reasonable steps to restore access or provide a replacement.

Limitations of liability apply only to the extent permitted by mandatory law. Liability for intent, gross negligence, injury to life or health, and any other cases where liability cannot legally be limited remains unaffected by these terms.

31. Processing of personal data

The participant's personal data is processed to the extent necessary to arrange payment, perform the contract, provide access, communicate, administer the subscription, and comply with mandatory legal requirements.

Detailed information about the categories of data processed, legal bases, storage periods, services used, and the participant's rights is set out in the separate Privacy Policy published on shamrei.space.

32. Termination of access due to breach of the terms

The provider may limit or terminate the participant's access in the event of a material breach of these terms, including sharing access with third parties, unlawful distribution of the materials, commercial use of the materials without the provider's consent, or conduct that creates a risk to the safety or rights of other participants.

Where the nature of the breach allows it, the provider gives prior notice and a reasonable opportunity to remedy the breach.

This section does not limit mandatory consumer rights.

33. Changes to these terms

The provider may change these terms for future purchases and for future subscription billing periods.

For an already paid one-time purchase or an already started paid period, the terms in force at the time the relevant contract was concluded continue to apply unless mandatory law requires otherwise or the parties agree otherwise.

If the conditions of an ongoing subscription change materially, the participant is notified before the new conditions take effect and may cancel the subscription before the next charge.

34. Governing law

The contractual relationship between the provider and the participant is governed by the law of the Republic of Austria.

If the participant is a consumer, this choice of law does not limit mandatory rights that cannot be excluded or restricted by contract under the applicable law.

35. Complaints and contact

The participant is encouraged to include their name, the email used for payment, the name of the offer, the date of payment, and a description of the issue.

36. Severability

If an individual provision of these terms is found invalid or unenforceable, this does not affect the validity of the remaining provisions.

In place of the invalid provision, mandatory legal rules and any permissible arrangement that comes closest to the purpose of the original provision apply.
